THE PUBLIC ORDER (BANNING OF POLITICAL UNIFORMS) ORDER
1. |
This Order may be cited as the Public Order (Banning of Political Uniforms) Order.
|
2. |
(1) |
The wearing in public places or at public meetings of uniform or any distinctive dress which signifies association with any political organisation or with the promotion of any political object is hereby prohibited.
|
(2) |
Any person who contravenes the provisions of subparagraph (1) of this paragraph shall be guilty of an offence and liable to a fine not exceeding one thousand shillings or to imprisonment for a term not exceeding two months, or to both such fine and such imprisonment.
|

Regulations under section 22
1. |
These Regulations may be cited as the Public Order (Notification of Public Meetings and Processions) Regulations, 1997.

2. |
Every notice to the regulating officer under subsection (2) of section 5 of the Act shall be in the form set out in the Schedule.
|
3. |
The Public Order (Licenses for Public Meetings or Processions) Regulation are revoked.
|

Section 11 of the Act is applied throughout Kenya during all hours of the day and night.

These Regulations may be cited as the Public Order (Notification of Public Meetings and Processions) Regulations.

2. |

THE PUBLIC ORDER (CURFEW) (TANA RIVER, TANA NORTH AND TANA DELTA DISTRICTS) ORDER, 2012
1. |
This Order may be cited as the Public Order (Curfew) (Tana River, Tana North and Tana Delta Districts) Order, 2012, and shall be deemed to have come into operation on the 11th September, 2012.
|
2. |
This Order shall apply to all that area comprised in the Tana River, Tana North and Tana Delta Districts of the Republic of Kenya (hereinafter referred to as "the specified area").
|
3. |
This Order shall apply during the hours of darkness, viz the period between half-past six in the evening and half-past six on the following morning for a period of one month.
|
4. |
Under this Order, the following directives shall apply—
(a) |
no public gathering or procession shall have more than five persons;
|
(b) |
no person not ordinarily resident in the specified area shall be or remain therein during the hours specified in paragraph 3 unless—
(i) |
the person in the Kenya Defence Forces, the Kenya Police Service or the Administration Police Service; |
(ii) |
the person has written permission from the District Commissioner, the District Officer or the officer commanding the Police unit in the respective area; |
|
(c) |
no person shall, without lawful excuse, possess or carry any offensive weapon.
|

THE PUBLIC ORDER (CURFEW) (MANDERA, WAJIR, GARISSA AND TANA RIVER COUNTIES) ORDER, 2015
1. |
This Order may be cited as the Public Order (Curfew) (Mandera, Wajir, Garissa and Tana River Counties) Order, 2015, and shall be deemed to have come into effect on the 17th May, 2015 to 16th June, 2015.
|
2. |
This Order shall apply to all that area comprised in Mandera, Wajir, Garissa and Tana River Counties of the Republic of Kenya (hereinafter referred to as "the specified area").
|
3. |
This Order shall apply during the hours of darkness, viz the period between half-past six (18.30 hrs.) in the evening and half-past six (06.30 hrs.) on the following morning for a period of one (1) month.
|
4. |
Under this Order, the following directives shall apply—
(a) |
no gathering or procession shall have more than five persons without the organizers thereof first having reported to the County Commander of the National Police Service;
|
(b) |
of the intention and purpose of such gathering or procession and, having obtained written permit to hold the gathering or procession;
|
(c) |
no person not ordinarily resident in the specified area shall be or remain therein during the hours specified in paragraph 3 unless—
(i) |
the person is in the Kenya Defence Forces, or the National Police Service; |
(ii) |
the person has written permission from the County Commissioner, or the County Commander of the National Police Service or the Officer commanding the Police Unit in the respective area; |
(iii) |
the person is on transit and is on temporary accommodation in a duly licensed hospitality facility as a guest and such person has duly registered in the facility as such guest with full and proper identification recorded in the specified register for the registration of guests. |
|
(d) |
no person shall, without lawful excuse, possess or carry in public any offensive weapon.
|

THE PUBLIC ORDER (CURFEW) (MANDERA COUNTY) ORDER, 2016
1. |
This Order may be cited as the Public Order (Curfew) (Mandera County) Order, 2016, and shall come into effect on the 27th October, 2016 to 27th December, 2016 from 6.30 p.m. to 6.30 a.m.
|
2. |
This Order shall apply to all that area comprised in Mandera Town, Omar Jillo, Arabia, Fino, Lafey Kotulo, Elwak and the environs of the said locations extending to twenty (20) kilometers from Kenya/Somalia Border. Every person who resides within the Sub-County shall except under, and in accordance with the terms and conditions of a written permit granted by the respective Deputy County Commissioner for the affected areas, remain indoors in the premises at which they reside or at such other premises as may be authorized.

THE PUBLIC ORDER (CURFEW) (MANDERA COUNTY) EXTENSION ORDER, 2017
1. |
This Order may be cited as the Public Order (Curfew) (Mandera County) Extension Order, 2017 and shall come into effect on the 28th March, 2017.
|
2. |
This Order extends the Public Order (Curfew) (Mandera County) Order, 2016 (L.N. 183/2016).
|
3. |
This Order shall apply to the area comprised in Mandera Town, Omar Jillo, Arabia, Fino, Lafey Kotulo, Elwak and the environs of the said locations extending to twenty kilometres from Kenya-Somalia Border with effect from the 28th March, 2017 to 28th June, 2017.
|
4. |
This Order shall apply during the hours of darkness, between the period between 7:00 p.m. in the evening and 5:00 a.m. in the morning. 5. Every person who resides within the said areas shall, except in accordance with the terms and conditions of a written permit granted by the respective Deputy County Commissioner for the affected areas, remain indoors in the premises at which they reside or at such other premises as may be authorized.

THE PUBLIC ORDER - EXTENSION OF THE PUBLIC ORDER (CURFEW) (CHEPTAIS SUB-COUNTY) ORDER, 2018
EXTENSION OF THE PUBLIC ORDER (CURFEW) (CHEPTAIS SUB-COUNTY) ORDER, 2018 [L.N. 123/2018.] IN EXERCISE of the powers conferred by section 8(1) of the Public Order Act, the Cabinet Secretary for Interior and Co-ordination of National Government extends Legal Notice No. 59 of 6th March, 2018 (The Public (Curfew) Order (Cheptais Sub-County) Order, 2018) for thirty (30) days with effect from 6th June, 2018 to 5th July, 2018 between 07:00 p.m. to 6.00 a.m.

Citation
This Order may be cited as the Public Order (State Curfew) Order, 2020.

2. |
Application
This Order shall apply to the entire territory of the Republic of Kenya.
|
3. |
Curfew period
This Order shall apply during the hours of darkness between seven o'clock in the evening and five o'clock in the morning with effect from the 27th March, 2020 and shall remain in effect for a period of thirty days thereof.
|
4. |
Restrictions
Under this Order, there shall be no public gatherings, processions or movement either alone or as a group during the period of the curfew except as shall be permitted, in writing, by a police officer in charge of the police in a county or a police officer in charge of a police division.
|
4A. |
To facilitate compliance with the Order, all employers shall ensure that their staff who are not designated as critical or essential services providers leave the workplace no later than 4:00 O'clock in the afternoon.

Exemption
Notwithstanding the provisions of this Order, the Order shall not apply to the services, personnel or workers specified in the Schedule hereto.

Application
This Order shall apply mutatis mutandis in the following specified area within Kilifi County, Malindi Sub-County, Lango Baya Division comprising of:
(i) |
Chakama Ranch and its boundaries identified as L.R. No. 13472/1 measuring 20,418 Ha. in Chakama Location. |
|
3. |
Curfew Period
This Order shall take effect from 25th April, 2023 commencing at 6.00 p.m. in the evening up to 6.00 a.m. in the morning and shall remain in force for a period of thirty (30) days thereof.

Curfew Period
This Extension Order shall apply during the hours of darkness between Six O’clock in the evening and Six O’clock in the morning with effect from 18th May, 2023 and shall remain in effect for a further period of thirty (30) days.

4. |
Restriction
Under this Extension Order, there shall be no public gatherings, processions or movement, either alone or as a group during the period of the curfew except as has been permitted in writing by the Inspector-General of the National Police Service.

5. |
Exemption
Notwithstanding the provisions of this Order, the Order shall not apply to the services, personnel or workers specified in the Schedule hereto.

Citation
1. This Order may be cited as the Declaration of Disturbed and Dangerous Areas (Turkana, Elgeyo Marakwet, Baringo, West Pokot, Samburu and Laikipia Counties) Extension Order, No. 7 of 2023.
Application
2. This Extended Order shall apply in the following specified areas in Turkana, Elgeyo Marakwet, Baringo, West Pokot, Samburu and Laikipia Counties.
1. TURKANA COUNTY–Turkana South and Turkana East Sub-counties (Loima Sub-county is exempted)
2. WEST POKOT COUNTY–Pokot North and Sigor Subcounties (along the River Turkwel Escarpment)
3. ELGEYO MARAKWET COUNTY — Marakwet East and Marakwet West Sub-counties
4. BARINGO COUNTY — Mukutani, Muchongoi, Bartabwa, Tiaty East and Tiaty West Sub-counties

IT IS notified for general information to the public on exemption on application of the Curfew Extension Order for a part of Turkana County identified as below—

Application
The whole of Loima Sub-County in Turkana County has been exempted from the Curfew Extension Order with effect from the 21st June, 2023.

THE PUBLIC ORDER (STATE CURFEW EXTENSION) KILIFI COUNTY CURFEW ORDER NO. 3 OF 2023
IN EXERCISE of the powers conferred by section 8(1) and section (3) (1) of the Public Order Act (Cap. 59) and arising out of unexplained mass death and burials in Kilifi County, and the urgent need by Government to conduct security operations for search, rescue and or retrieval of living persons and or dead bodies, the Cabinet Secretary for Interior and National Administration makes the following Order—
1. This Order may be cited as the Public Order (State Curfew Extension) (Restriction of Movement) No. 3 of 2023.
2. This Order shall apply mutatis mutandis in the following specified area within Kilifi County, Malindi Sub-County, Lango Baya Division comprising of:

Chakama Ranch and its boundaries identified as L.R. No. 13472/1 measuring 20,418 Ha. in Chakama Location. |
Curfew Period
3. This Order shall take effect from the 27th June, 2023 commencing at 6.00 p.m. in the evening upto 6.00 a.m. in the morning and shall remain in force for a period of thirty (30) days thereof.
4. Under this Order, there shall be no public gatherings, processions or movement either alone or as a group during the period of curfew into and out of Lango Baya Division except as shall be permitted, in writing, by the County Police Commander.
